Ultimate Holdem Timer Terms of Service

1. Description of Services

Ultimate Holdem Timer provides professional tools for planning, creating, hosting, and managing poker tournaments. Our services include, but are not limited to:

• Configuring poker tournaments and poker clocks.
• Displaying time, prize pool calculations, and player tracking.
• Designing poker clock interfaces and custom poker chips.
• Calculating tournament structures and payout distributions.
• Multi-monitor display support for tournament rooms.

Users interact with our services exclusively through our web interface. No user account is required for basic access — you can use UHT fully anonymously. Optionally, you may create a free account to unlock additional features, cloud storage, and premium capabilities. Account creation is always voluntary.

UHT offers three account tiers:

• Free: Basic features, limited cloud storage. No cost.
• Supporter: Extended features and higher cloud storage limits.
• Commercial: Full feature access, maximum cloud storage, commercial use permitted.

3. Privacy and Data Collection

Anonymous Use: If you do not create an account, you use UHT anonymously. Only standard technical metadata (IP address, browser type, country, pages visited) is collected for aggregate usage statistics. No personal data is required or stored.

Account Use: If you create an account, UHT collects your email address and display name. All tournament configurations, designs, sounds, and other content you create may be stored on UHT servers.

Social Login: You may register and log in using Google or Microsoft. In these cases, UHT only exchanges an authentication token with the provider and does not share any additional user information with the social login provider.

No Ads, Trackers, or Cookies: UHT does not use third-party trackers, cookies, display ads, or social media widgets. We do not share user data with external parties.

Payment Processing: Payment transactions are handled by Stripe. UHT does not store any payment card data or any other user-related payment information. Receipts and invoices are stored by Stripe.

GDPR Compliance: All data collection practices are fully compliant with the General Data Protection Regulation (GDPR). See our full Privacy Policy for details.

4. Commercial Usage and Licensing

Personal/Private Use: The Ultimate Holdem Timer service is free for personal and private usage with or without an account.

Commercial Use: Use of the service for commercial purposes requires a Commercial license — regardless of the number of players participating. Commercial usage includes, but is not limited to, any activity where the service is used in a manner that directly or indirectly generates revenue:

• Direct Revenue: Charging fees for tournament entries or collecting registration fees.
• Indirect Revenue: Hosting events where revenue is generated from ancillary sources (bars, poker leagues, or venues earning income from food, beverages, or services).
• Professional Venues: Operating in a casino or professional poker venue.
• Business Services: Providing tournament services as part of a business.
• Corporate Events: Hosting tournaments at company or corporate events.
• For-Profit Organizations: Running for-profit card clubs or poker clubs.

Account Sharing: Sharing your UHT account with other individuals is not permitted. An exception applies for organizations operating under a Commercial License, where shared use within the licensed organization at the registered location is permitted. Violations may result in license revocation, account suspension, or reset to the free tier.

5. Account Types and Features

When you create an account, you unlock the ability to store tournament configurations, display designs, and sounds on UHT servers. The amount of content you can store and the features available depend on your account tier:

• Free: Basic cloud storage, core tournament features, anonymous usage statistics.
• Supporter: Increased cloud storage, extended features, priority features.
• Commercial: Maximum cloud storage, all features, commercial use permitted, multi-location use with separate license per location.

Feature and storage limits are displayed in your account settings. UHT reserves the right to adjust tier benefits with reasonable notice.

6. Multi-Monitor (MM) Feature

The Multi-Monitor (MM) feature allows you to display your tournament on multiple screens simultaneously. The following conditions apply:

• Account Required: You must have a UHT account to use the MM feature.
• Server-Hosted: When MM is enabled for a tournament, the tournament instance is hosted directly on UHT servers instead of locally in your browser.
• Automatic Deletion: The tournament instance on UHT servers is retained for the duration of the tournament plus 3 hours, after which it is automatically and permanently deleted.
• Manual Deletion: The instance is also deleted immediately when you manually disable MM for the tournament.

You are responsible for ensuring that the tournament data you host via MM complies with these Terms.

7. Payments and Refunds

Payment Processing: Licensing payments are processed via Stripe. Ultimate Holdem Timer does not store any payment card information.

Digital Product: This is a digital product with immediate access. The customer has agreed to the start of service and waived the right of withdrawal as required by EU Directive 2011/83/EU (Art. 16).

Refund Policy: All payments are final. Refunds are not available once a payment has been processed.

8. Disclaimer of Warranties and Limitation of Liability

Service "As Is": The Ultimate Holdem Timer service is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee continuous availability or the flawless operation of all features.

Accuracy of Calculations: While we strive for accuracy, Ultimate Holdem Timer does not guarantee the correctness of tournament and prize pool calculations. Users are responsible for verifying all calculations.

Limitation of Liability: In no event shall Ultimate Holdem Timer, its owners, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the service.

9. Governing Law and Dispute Resolution

Governing Law: These Terms and any disputes arising out of or relating to these Terms or the use of the Website shall be governed by and construed in accordance with German law.

Company Information: Ultimate Holdem Timer is registered under German law and is the property of BIGG Solutions.

Dispute Resolution: Any disputes will be resolved in accordance with the laws of Germany. Misuse of the service, including unauthorized commercial usage, may lead to immediate revocation of access and legal action.

Ultimate Holdem Timer incorporates content created by third parties, used in accordance with their respective open source, MIT, or other applicable licenses:

Ultimate Holdem Timer reserves the right to modify these Terms at any time. We will notify users of significant changes via the Website or by other appropriate means. Your continued use of the Website after any such changes constitutes your acceptance of the revised Terms.

12. Termination

Ultimate Holdem Timer reserves the right to terminate or restrict access to the service at its sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the service itself. Upon termination of an account, all user content stored on UHT servers will be deleted, except for records required to be retained by law (such as payment receipts and invoices).

13. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Ultimate Holdem Timer regarding your use of the service.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
